The supreme court of India on Tuesday said that cast of the parties will not be mentioned in the
cause titles of judgement.
Justice Rajesh Bindal and Abhay Shreeniwas Oka advised in the trials courts not to put the cast
of someone next to their name in cause title.
"We may note that in the cause title of the judgment handed down by the ld. Special Judge in
Kota, Rajasthan, under the POCSO Act. The accused's caste has been mentioned in the Cause
Title. We are of the view that such practice ought to never be followed and that the preliminary
courts share all around encouraged to not make reference to standing in the reason title of
decisions."
According to the High Court, there was no mistake on the part of the trial court when it found the
accused appellant guilty of violating the relevant provisions of the POCSO Act and the Indian
Criminal Code. The High Court, however, lowered the The Registrar General of the Rajesthan
High court was orderd by the benched to send the copies of this order to all of the state’s
principal, District, and Sessions Judges.
The Rajasthan High Court ruling that reduced the sentence for a rape prisoner under the POCSO
Act was being challenged accused's sentence from life in prison to 12 years of harsh
imprisonment owing to various factors, including his age, financial situation, having served more
than 5 years in jail, and being a first-time offender.
The Respondent's next hearing date and other necessary steps should be taken if he wants legal
representation, the Court had instructed the Prison Superintendent.
"The petitioner will let the jail chief know to let the respondent know when the next hearing date
is set. The Respondent may select his own attorney, the Prison Superintendent will tell him. In
order for the Supreme Court Legal Services Committee to be able to assign a lawyer to represent
the respondent's interests if the respondent requests legal aid, the jail superintendent must submit
the proper application.
Judge Bindal drew attention to the statement of the respondent's caste after passing the order.
Why should we bring it up? My brother is entirely correct," Justice Oka said. The State's attorney
said that it is mentioned in Rajasthan and added that occasionally the caste of the accused is
included in FIRs. The attorney further emphasized that casting information was allowed to be
mentioned in the Supreme Court Rules.
